Acceptable Use Policy

1. Overview
This Acceptable Use Policy ("AUP") governs your use of the Notable Service. It is incorporated by reference into our Terms of Service. By using the Service, you agree to comply with this AUP. Notable may update this AUP from time to time; the current version is always available at withnotable.ai/acceptable-use.
Violation of this AUP may result in warning, suspension, or termination of your account, removal of content, and where appropriate, reporting to law enforcement or other authorities. We may act on suspected violations without prior notice when we reasonably believe immediate action is necessary to protect Notable, our users, or third parties.
2. Prohibited Uses
You may not use the Service to:
2.1 Violate Law or Third-Party Rights

Engage in any unlawful, fraudulent, deceptive, or misleading activity.

Infringe any intellectual property, privacy, publicity, contract, or other right of any third party.

Violate the Fair Housing Act, state fair housing laws, or any anti-discrimination law in your marketing, content, or operations.

Violate the NAR Code of Ethics, your state real estate commission rules, your MLS rules, or your brokerage policies.

Violate CAN-SPAM, the Telephone Consumer Protection Act (TCPA), state telemarketing or anti-solicitation laws, or applicable email and SMS marketing laws in connection with any outreach you conduct using content generated by the Service.
2.2 Generate or Distribute Harmful Content

Use the Service to create content that is defamatory, libelous, harassing, threatening, abusive, or invasive of another's privacy.

Use the Service to create content that targets, demeans, or discriminates against any protected class, including content that uses prohibited language under fair housing rules (e.g., suggesting preference or limitation based on race, color, religion, sex, national origin, familial status, disability, or other protected characteristic).

Use the Service to publish content you know to be false, including false claims about transaction history, credentials, certifications, awards, or affiliations.

Use the Service to impersonate another person or misrepresent your affiliation with any person or entity.
2.3 Misuse Information About Other Real Estate Professionals

Submit information about another real estate professional with the intent to harm their reputation, business, or licensure.

Use scan results, competitor data, or any third-party information surfaced through the Service to engage in harassment, defamation, or unfair competition.

Scrape, redistribute, resell, or republish competitor data or third-party information from the Service except as a normal part of your own marketing and business operations.
2.4 Compromise the Service or Third-Party Platforms

Interfere with, disrupt, or attempt to gain unauthorized access to the Service, accounts, computer systems, or networks.

Probe, scan, or test the vulnerability of the Service or any related system without prior written authorization from Notable.

Use bots, scrapers, or automated means to access or extract data from the Service beyond what is normally exposed to users, or to circumvent rate limits or other technical controls.

Use the Service in a way that intentionally degrades, manipulates, or attempts to game third-party AI platforms (such as keyword stuffing, prompt injection at scale, or coordinated manipulation of indexing).

Introduce viruses, malware, or other harmful code.
2.5 Account Misuse

Share your account credentials or allow another person to access the Service through your account, except as expressly permitted (e.g., Brokerage Admins inviting Brokerage-Managed Agents through the standard flow).

Create multiple accounts to evade limits, suspensions, or terminations.

Resell, sublicense, or commercially exploit access to the Service except as expressly authorized.

Misrepresent your identity, your role, your authority, or your affiliation when creating an account or accepting these terms on behalf of a Brokerage Customer.
2.6 Misuse of AI Outputs and Generated Content

Publish AI-generated content without reviewing it for accuracy, compliance with applicable laws and codes, and appropriateness.

Pass off AI-generated content as authored by another person without permission.

Use the Service to generate content that you intend to use in a manner that violates this AUP or any law.
2.7 Privacy Violations

Submit personal data of any individual (other than yourself or your authorized End Users) without their permission or another lawful basis to do so.

Use the Service or scan results for surveillance, stalking, harassment, or any purpose that infringes a person's privacy or safety.

Submit sensitive personal data (such as Social Security numbers, financial account numbers, government IDs, health information, biometric data, or precise geolocation) to the Service.
3. Real Estate Industry-Specific Requirements
Because the Service is used by licensed real estate professionals, the following industry-specific rules apply:

You are responsible for ensuring that all marketing content, web pages, social posts, and other materials generated or assisted by the Service comply with your state's real estate advertising rules, including license disclosure, team naming rules, and "team" vs. "brokerage" distinctions.

You must include any disclosures required by your state real estate commission and your brokerage in published content.

You must not represent yourself as having credentials, certifications, or designations you do not hold.

You must not make guarantees of specific market outcomes (e.g., "I will sell your home in X days") in published content unless permitted and substantiated under applicable law.

You must not use the Service to bypass MLS data rules or republish MLS data in violation of your MLS agreement.
4. Reporting Violations
To report a suspected violation of this AUP, including content generated about you or your business that you believe is inappropriate, contact abuse@withnotable.ai. We will investigate reports we receive and take appropriate action.
5. Enforcement
Notable may, in its discretion, take any of the following actions in response to a suspected or confirmed violation of this AUP: (a) warning the user; (b) temporary or permanent suspension of access; (c) removal or modification of offending content; (d) termination of the account; (e) refusal to provide further service; or (f) reporting to law enforcement or other appropriate authorities. Notable's exercise (or non-exercise) of any of these rights is not a waiver of any other right or remedy.
6. Changes to This AUP
Notable may update this AUP from time to time. Material changes will be communicated by email or through the Service. Your continued use of the Service after the effective date of an updated AUP constitutes acceptance.
